§ 1. GENERAL PROVISIONS

1.1. These Terms of Service (hereinafter: “Terms”) set out the rules and conditions for participation in the HackOn — Agentic Software Engineering Hackathon event (hereinafter: “Event”), organized by Comerito Patryk Lewczuk (hereinafter: “Organizer”), and the rules for ticket sales via the website hackon.openmercato.com (hereinafter: “Website”).

1.2. The Organizer of the Event is:

1.3. These Terms constitute terms of service for the provision of electronic services within the meaning of the Polish Act of 18 July 2002 on the provision of electronic services.

1.4. Purchasing a ticket and participating in the Event requires reading and accepting these Terms.

1.5. The Terms are made available free of charge via the Website in a format that allows downloading, saving, and printing.


§ 2. DEFINITIONS

2.1. Ticket — a document (in electronic form) confirming the conclusion of a participation agreement for the Event and entitling the holder to attend.

2.2. Participant — a natural person who has purchased a Ticket in accordance with the Terms.

2.3. Consumer — a natural person purchasing a Ticket for purposes not directly related to their business or professional activity.

2.4. Entrepreneur — a natural person, legal entity, or organizational unit purchasing a Ticket as part of their business or professional activity.

2.5. Order — a declaration of intent by the Participant to conclude a participation agreement for the Event via the Website.


§ 3. EVENT

3.1. The Event takes place from April 10, 2026 to April 12, 2026 at the location: Autopay S.A., ul. Powstańców Warszawy 6, 81-718 Sopot, Poland.

3.2. The Event is a technology hackathon focused on Agentic Software Engineering, including programming sessions, talks, demo presentations, and an award ceremony.

3.3. The detailed Event program is published on the Website and may be subject to change. The Organizer reserves the right to modify the program for important organizational reasons.

§ 4. TICKETS AND PRICING

4.1. Tickets for the Event are available on the Website in limited quantities. The Organizer reserves the right to end sales at any time once tickets are sold out.

4.2. Tickets are available in the following price categories:

4.3. The Ticket price is binding at the time the Order is placed. The Organizer reserves the right to change ticket prices; however, changes do not apply to Orders already placed.

4.4. The Organizer may offer Tickets in different price categories (e.g., Early Bird, Regular, Last Minute). The conditions for each category are specified on the Website.

4.5. A VAT invoice is issued upon the Participant’s request. Invoice details should be provided during the purchase process or sent to the Organizer’s email address.


§ 5. ORDERING AND PAYMENT

5.1. Orders are placed via the form available on the Website.

5.2. To place an Order, the Participant:

5.3. Clicking the Order confirmation button constitutes an offer to the Organizer to conclude a participation agreement for the Event.

5.4. Payment is processed via:

5.5. The participation agreement for the Event is concluded when the payment is credited to the Organizer’s account or confirmed by the online payment operator.

5.6. After the agreement is concluded, the Participant receives a purchase confirmation at the provided email address, including: Order number, purchase summary, Organizer’s details, and the Terms or a link to the Terms.


§ 6. RIGHT OF WITHDRAWAL

6.1. Pursuant to Article 38(12) of the Polish Act of 30 May 2014 on Consumer Rights, the Consumer is not entitled to withdraw from a distance contract for services related to accommodation (other than residential), transport of goods, car rental, catering, leisure, entertainment, sports, or cultural events, if the contract specifies a date or period for the provision of the service.

6.2. The Event has a specified date and period of service provision; therefore, the right of withdrawal does not apply to Consumers, of which the Consumer is informed before placing the Order and confirms during the purchase process.

6.3. The above does not exclude the Participant’s right to file a complaint under § 9 of the Terms.


§ 7. CONDITIONS OF PARTICIPATION

7.1. The Participant is obligated to:

7.2. The Organizer reserves the right to refuse entry or remove from the Event any Participant who violates the Terms, Code of Conduct, or behaves in a manner that endangers the safety or comfort of other Participants. In such cases, the Participant is not entitled to a Ticket refund.

7.3. During the Event, photographs and video recordings may be taken for the Organizer’s documentation and promotional purposes. By accepting the Terms, the Participant consents to the capture and distribution of their image in the Organizer’s promotional materials, unless they object to the Organizer before the Event begins.


§ 8. INTELLECTUAL PROPERTY

8.1. Source code, projects, and other works created by Participants during the Event (hereinafter: “Hackathon Works”) remain the property of their creators, unless the rules of a specific track provide otherwise.

8.2. All materials provided by the Organizer (presentations, tools, boilerplate code) remain the property of the Organizer or third parties and are made available to Participants solely for the duration and purposes of the Event.


§ 9. COMPLAINTS

9.1. Complaints regarding Ticket purchases or the Event should be submitted to the email address: patryk@openmercato.com or in writing to the Organizer’s registered address.

9.2. A complaint should include: the Participant’s name, contact details, Order number, a description of the problem, and the expected resolution.

9.3. The Organizer handles complaints within 14 days of receipt and informs the Participant of the resolution at the provided email address.

9.4. The Consumer may use out-of-court complaint and claim resolution methods, including:


§ 10. EVENT CANCELLATION OR CHANGES

10.1. The Organizer reserves the right to cancel the Event due to circumstances beyond its control (force majeure, administrative decisions, sanitary conditions, etc.).

10.2. In the event of cancellation by the Organizer, the Participant is entitled to a full Ticket refund. The refund is processed within 14 days of informing the Participant of the cancellation, to the bank account from which the payment was made, or in another agreed manner.

10.3. In the event of a significant change in the Event date or location, the Participant has the right to withdraw and receive a full Ticket refund, provided the withdrawal is submitted within 7 days of receiving notification of the change.

10.4. The Organizer is not liable for costs incurred by the Participant in connection with the cancellation or change of the Event (e.g., travel, accommodation costs).


§ 11. LIABILITY

11.1. The Organizer exercises due diligence to ensure proper Event organization.

11.2. The Organizer is not liable for:

11.3. To the extent permitted by applicable law, the Organizer’s total liability to a non-Consumer Participant is limited to the amount equal to the Ticket price.


§ 12. PERSONAL DATA

12.1. The controller of Participants’ personal data is the Organizer.

12.2. Detailed information about personal data processing, including purposes, legal bases, retention periods, and data subjects’ rights, can be found in the Privacy Policy.

12.3. Providing personal data is voluntary but necessary for concluding the Event participation agreement.


§ 13. TECHNICAL REQUIREMENTS

13.1. Using the Website requires:

13.2. The Organizer is not responsible for technical problems resulting from failure to meet the above requirements.


§ 14. FINAL PROVISIONS

14.1. The Terms become effective on the date of publication on the Website.

14.2. The Organizer reserves the right to amend the Terms for important reasons. Amendments do not apply to Orders placed before their effective date.

14.3. Matters not regulated by these Terms are governed by Polish law, in particular the Civil Code, the Consumer Rights Act, and the Act on Electronic Service Provision.

14.4. Disputes with Consumers shall be resolved by the competent common court in accordance with the Code of Civil Procedure. Disputes with Entrepreneurs shall be resolved by the court having jurisdiction over the Organizer’s registered office.

14.5. In the event of discrepancies between language versions of the Terms, the Polish version shall prevail.
